The most unexpected thing about today's ruling in the US Supreme Court about Obama care wasn't so much that it was approved with a narrow 5-4 margin, but that the swing vote was John Roberts and not Anthony Kennedy. Usually it is Kennedy that is the swing vote, while Roberts is considered to be part of the conservative bloc, together with Clarence Thomas, Antonio Scalia and Samuel Alito. But now it would seem then that the Supreme Court has four reliable liberals, three reliable conservatives and two swing voters.

As for the ruling, two things should be noted. First of all, it is clear that the mandate to buy health insurance means a reduction in the freedom of Americans. Secondly, it is however also clear that it is no more so than existing welfare state programs like Medicare and Social Security, where people are in effect through the tax system forced to buy health insurance and pension insurance for when they become older than 65. So if Obamacare is unconstitutional, then there wouldn't have been any reason not to consider Medicare and Social Security as unconstitutional, something that few leading Republicans would openly argue for.

As for the political impact, Mitt Romney is the big loser. Some argue that he is a winner because the health care insurance mandate is unpopular, but I disagree considering that he as recently as 2007 called it "ultimate conservatism" and has yet to renounce his old statements he simply has no credibility arguing against Obamacare.

President Obama recently issued an edict exempting an estimated 800,000 to 1 million illegal aliens from the consequences of federal immigration law. Ostensibly that blanket amnesty applies to those who arrived before the age of 16 and are younger than 30; who are in, or graduated from, high school or have served in the military; and who have not been convicted of a felony or multiple misdemeanors. And while most Americans sympathize with helping those who were brought into the United States as toddlers, raised as de facto Americans and followed the rules, the policy of exempting hundreds of thousands en masse in the long run may create far more problems than it solves.

First was the cynical timing. In 2009 and 2010, Democrats had a supermajority in the Senate and a majority in the House and could easily have enacted such a law over all opposition. So why was the edict handed down in a tough campaign year?

Then there is a problem of constitutionality, an especially serious issue for former constitutional law lecturer Barack Obama, who ran on the premise that he would restore respect for the separation of powers. But as seen in the reversal of the order of the Chrysler creditors, the attempt to shut down a non-union Boeing plant in South Carolina, the decision not to enforce the Defense of Marriage Act, and the recent use of executive privilege not to hand over Fast and Furious documents, this administration sometimes just bypasses a now-difficult Congress to rule by fiat.

The move contradicts Obama?s earlier claim that a de facto amnesty ?would not conform with my appropriate role as president.? He later reiterated that ?some people want me to bypass Congress and change the laws on my own,? but ?that?s not how our system works.?

In theory, the federal government currently treats illegal aliens on a case-by-case basis, as it allots limited resources to determine who most urgently should be deported and who need not be. The president has added some vague qualifiers to his blanket proclamation concerning schooling and criminal activity. But given that in a state like California, Hispanic males are dropping out of high school at a rate of nearly 40 percent, will the new policy result in summary deportations? That is, once we have chosen those who will not be deported, do we then go after thousands who dropped out, went on state assistance or have been convicted of crimes? And how do we authenticate age and length of residency?

Not long ago, the president, in explaining his personal desire for some sort of amnesty, lamented to Hispanic leaders that they needed to ?punish our enemies? at the polls. But is illegal immigration always the single most important issue for Hispanics? Some polls show the Latino community divided almost evenly over open borders. That is understandable, given that the presence of 11 million to 15 million illegal aliens masks the national profile of Latino success. In terms of the rates of assimilation, integration, intermarriage and economic ascendency, Latino Americans who legally immigrated to the United States are mirroring past experiences of successful southern European immigrants.

In Southwestern states, American citizens of Hispanic ancestry share in the increased costs associated with spiraling incarceration rates, plummeting test scores and overtaxed social services, which at least in part reflect the difficult efforts to accommodate those who arrived illegally from the poorest regions of Latin America. A cynic might argue that employers and identity-politics elites jointly welcomed in illegal aliens, the former wanting cheaper labor, the latter wanting more constituents. But driving down wages in hard times and increasing government costs is not always beneficial for small businesses and entry-level American workers ? increasing numbers of them Hispanics.

Finally, is it wise to tie our immigration policy so intimately to race and ethnicity, rather than individual merit and circumstances? Presently we equate massive influxes with Latin America and particularly Mexico. But we forget that Asians now comprise the largest group of new immigrants. Almost all come legally, and many arrive with capital, college educations and specialized skills. Following the president?s election-year example, are we to expect the Asian community, in the fashion of Latino lobbyists, to demand even more visas for kindred groups? Should we now waive the immigration rules for economic refugees from the collapsing European Union?

The president?s decision is politically tainted, constitutionally suspect, cynically timed and poorly thought out. But it did result in one unintended consequence: We are reminded once again that there are millions of foreign nationals dying to reach the United States ? and to stay at any cost after they get here.

He explains in a long and characteristically profane email that is clearly unedited, if only because of the number of typos:

My goal here is that people coming to see my shows are?able to pay a fair price and that they be paying just for a?ticket. ?Not also paying an exhorbanant fee for the privalege of?buying a ticket.

Freestyles followed as Chris shored up his rap cred. And on the upcoming Fortune, he put the growth on display, teaming up again with F.A.M.E. collaborators Big Sean and Wiz Khalifa for the drum-laced "Till I Die."

On March 20 or 21 of each year, the Northern Hemisphere reaches the vernal equinox and enjoys the signs of spring. At the same time, the winds turn colder in the Southern Hemisphere as the autumnal equinox sets in.

The year's other equinox occurs on Sept. 22 or 23, when summer fades to fall in the north, and winter?s chill starts giving way to spring in the south.

From year to year, there is always some variability in the equinoxes and solstices because of the way Earth's changing tilt matches up with its orbit around the sun. This year, the precise moment of the June solstice came at 7:09 p.m. ET Wednesday. That's the moment when Earth's north pole was tipped precisely toward the sun.?

Tuesday thus represents the longest day of the year for the Northern Hemisphere's residents, and the longest night of the year south of the equator.

Effect on climate
Here?s how the seasonal change affects the weather: Around the time of the June solstice, the North Pole is tilted toward the sun and the Northern Hemisphere is starting to enjoy summer. The density of the solar radiation is higher because it's coming from directly overhead ? in other words, the sun's rays are concentrated over a smaller surface area. The days are longer, too, meaning that more radiation is absorbed in northern climes during the 24-hour cycle. Another factor that may come into play is that the radiation takes a somewhat shorter path through the energy-absorbing atmosphere before striking the earth.

At the same time that the Northern Hemisphere is entering summer, the South Pole is tilted away from the sun, and the Southern Hemisphere is starting to feel the cold of winter. The sun?s glancing rays are spread over a greater surface area and must travel through more of the atmosphere before reaching the earth. There are also fewer hours of daylight in a 24-hour period.

The situations are reversed in December, when it?s the Southern Hemisphere that basks in the most direct rays of the sun, while the Northern Hemisphere receives less dense solar radiation for shorter periods of time.

Although the solstices represent the pinnacles of summer and winter with respect to the intensity of the sun?s rays, they do not usually represent the year's warmest or coldest days. This is because temperature depends not only on the amount of heat the atmosphere receives from the sun, but also on the amount of heat it loses due to the absorption of this heat by the ground and ocean.

It is not until the ground and oceans absorb enough heat to reach equilibrium with the temperature of the atmosphere that we feel the coldest days of winter or hottest days of summer.

To say that Jericho is full of Raouf Omar is almost no exaggeration. The Glebe restaurant practically brims with its owner?s passions, past and present.

The room is typical of a family-run ethnic restaurant ? not fancy, but functional, clean and with a warm atmosphere so established that it seems to ooze from the walls and furniture.

Those walls are covered with Omar?s art, works of coloured glass cut into scenes of his former homes in Lebanon and the West Bank. There are perhaps two dozen of these pieces, vibrant and pleasant, and they give the room a Mediterranean feel. They?re so colourful that it took two visits before we noticed the large murals that Omar has painted on the ceiling.

The man himself is also there, greeting, serving, and generally making guests feel at home. He?s not overbearing, as many on-site owners can be in restaurants. The personal recollections he shares with us ? he?s Palestinian, and tells us he once worked as a sort of art ambassador for the PLO ? come only after we pepper him with questions. He is at once relaxed and intense. One of my guests, perhaps smitten, says Omar has ?a smouldering warmth.?

In the kitchen Omar, as executive chef, expresses himself again with a menu of ?Middle Eastern and Mediterranean food.? The names are familiar ? stuffed grape leaves, kebby, spanakopita, falafal ? but Omar has refined them to his own tastes, with great success.

On my first visit, a lunch, I order the ?house combo,? a name too inauspicious for what arrives at my table. In my experience, most Middle Eastern food in this city (and this country) is best eaten late at night, while drunk so you don?t taste its soulless mediocrity. In contrast, my ?house combo? at Jericho intoxicates with flavour.

Every element of the combo plate is a hit. The hummus has a smooth, creamy texture, and it doesn?t overwhelm with garlic. There?s a healthy dollop of it on the platter and ? for the first time in my life ? I eat all the hummus put before me. Even the pinkish cubes of pickled turnip go quickly, each tart and crunchy amid the hummus-stuffed pita.

The grape leaves are small, a little salty, but succulent. They?re stuffed with rice and veg and spices, and served warm, which is essential to their flavour but, sadly, not always the case in restaurants. There?s also an ample serving of green salad with a simple, tart dressing.

The fatayer ? a small, triangular pastry stuffed with spinach and cheese ? is warm and delightfully puffy. The star of the plate, to my tastes, is the kebby. Too often the dish is like a falafal with a bit of beef thrown in as an afterthought: Jericho?s kebby is crisp on the outside ? cooked fresh, obviously ? and full of aromatically spiced beef. During my second visit, with three guests, we all agree we?ve never had one better.

There?s only one misfire during the second visit, and it?s a fatayer with too much pastry and not enough filling. Otherwise, a second house combo plate impresses again.

With three guests along, the menu gets a thorough investigation ? even into the incongruous concessions to popular demand, with fish and chips, burgers and ?spicy chicken.? One guest opts for the spicy chicken and we?re all pleasantly surprised how moist and flavourful it is. The rice that comes with it is fragrant with saffron and cinnamon. (The chicken?s flavour notwithstanding, Omar should cut the non-Middle Eastern dishes from his menu, as their presence sends the wrong message to potential diners that the restaurant is not focused on its speciality.)

Another guest has the spanakopita plate, and it?s a massive serving of spinach, feta and spices inside phyllo pastry. It?s a challenge to eat it all, though the flavour compels us to try. My third guest has the lamb kafte, a sausage that?s crumbly on the inside and bursting with spicy flavour. Two large sausages disappear faster than two shakes of a lamb?s tail.

For afters we have a glass of rosewater iced tea, caffeine-free and wholly refreshing, and Oma?s homemade baklava. It?s drier than most baklava, but free of that syrupy goo that often makes the traditional treat icky. Like all the dishes on the menu, it?s a ?familiar taste, but slightly askew,? as my friend says.

That slight askewness is enough to make Jericho stand out, and the prices only add to the appeal. A hearty dinner for four, with dessert and a round of wine or crisp Tiger beers, was around $80. I was tempted to say, ?make it a $100 and give me a tub of hummus to go.?

'Dumb And Dumber To' Won't Happen Without Jim Carrey, Jeff Daniels Says

'Nobody's doing it without Jim,' Daniels tells MTV News after Carrey's reps announced he left the proposed sequel.

Jim Carrey's reps confirmed on Wednesday that he has left the proposed "Dumb and Dumber" sequel, the cleverly titled "Dumb and Dumber To," due to a conflict with the studios, New Line and Warner Bros.

Later that day, MTV News spokes with Carrey's co-star from the original, Jeff Daniels, as he walked the red carpet for his upcoming HBO series, Aaron Sorkin's "The Newsroom."

Daniels' answer was succinct and confirmed what many feared would be the implication of Carrey's departure. "No, nobody's doing it without Jim," he said.

As "Entertainment Tonight" had previously reported, Carrey exited the sequel to the Farrelly Brothers' follow-up to the 1994 comedy because New Line and Warner Bros. did not care enough about the project.

"According to sources, Carrey grew increasingly frustrated by New Line and Warner Brothers, who he felt showed a lack of enthusiasm regarding the project," "ET" claimed.

When the entertainment show reached out to Carrey's representation, they confirmed the departure and delivered a statement from the actor himself. "I would have thought 'Dumb and Dumber To' was a no-brainer," he said. "After all, it's implied in the title."

Daniels' insistence that a sequel would not happen without Carrey's involvement should not come as a surprise. The main draw of "Dumb and Dumber To" was that it would reunite the stars of the beloved movie for the first time.

"Dumb and Dumberer: When Harry Met Lloyd," a prequel to the original that featured none of the original's key players, bombed at the box office in 2003.

First CyanogenMod 9 nightly build available for international Samsung Galaxy S III

The first nightly build of popular custom ROM CyanogenMod 9 for the Samsung Galaxy S III  is now available for download. Following the release of several unofficial builds since the S III's international launch in late May, the first official nightly is available at the CyanogenMod download site. CyanogenMod 9, which is based on the Android Open Source Project, offers an experience closer to stock Android 4.0, as opposed to Samsung's TouchWiz UX.

Initial feedback from early adopters has been positive, and the list of known issues point out only a couple of minor issues with FM radio and camera flash. But as with any unofficial custom ROM, you'll need a rooted phone with a custom recovery to flash this, and you'll void your warranty in the process, so proceed at your own risk. We should also note that this ROM is for the international Galaxy S III only -- that's the one that's on sale in Europe and Asia right now, with the product code GT-i9300. The North American LTE version, due for release in the next few days, uses a different chipset and is not compatible.

New cerebellar ataxia gene identified in dogs

Researchers at the University of Helsinki and the Folkh?lsan Research Center, Finland, have identified the genetic cause of early-onset progressive cerebellar degeneration the Finnish Hound dog breed. The study, led by Professor Hannes Lohi, revealed a new disease mechanism in cerebellar degeneration. A mutation was identified in the SEL1L gene, which has no previous link to inherited cerebellar ataxias.

This gene find is the first in canine early-onset cerebellar degeneration, and has enabled the development of a genetic test to help eradicate the disease from the breed. At the same time, SEL1L represents a novel candidate gene in human early-onset degenerative ataxias.

The research was published in the scientific journal PLoS Genetics on June 14, 2012.

Inherited ataxias affect both humans and animals. In humans, the hereditary ataxias are a heterogeneous disease group, characterized by cerebellar degeneration and dysfunction. The cerebellum is a part of the brain that is involved in coordination of movement. Degeneration of the cerebellar structures causes ataxia, which is a neurological sign of defective motor coordination that can affect gait, balance, speech and gaze. Approximately 20 known disease-causing genes have been identified in both autosomal recessive and dominant ataxias in humans but the genetic background of canine cerebellar ataxias has remained largely unknown.

The clinical signs of Finnish Hound cerebellar ataxia are present by the age of two months. The affected puppies have difficulty in controlling their leg movements and keeping their balance. The disease progresses rapidly, and in the end eating becomes impossible because of uncontrolled head movements. There is no cure for the disease and affected puppies have to be euthanized.

The research conducted by Professor Lohi and co-workers revealed marked neuronal loss in the cerebellar cortex of affected Finnish Hound puppies. By comparing the genomes of affected and healthy dogs, the cause of the disease was pinpointed to a single nucleotide change in the SEL1L gene. The nucleotide alteration causes an amino acid change in the encoded SEL1L protein.

"The identified ataxia gene is the first early-onset degenerative cerebellar ataxia gene that has been identified in dogs", says professor Hannes Lohi. In addition to Finnish Hounds, cerebellar degeneration has been identified in several other dog breeds.

"The SEL1L gene has not been previously connected to cerebellar ataxias in any species and it represents a novel candidate gene for human early-onset ataxias", Lohi continues. "In fact, we have already screened a small cohort of human patients for possible disease-causing SEL1L mutations".

The gene identification in Finnish Hound dogs reveals a new disease mechanism, which will hopefully shed more light in to the pathogenesis of neuronal degeneration. The amino acid change in SEL1L hits an evolutionary conserved functional domain, and is very likely to affect the normal function of the protein. SEL1L functions in quality control of newly synthesized proteins, in a cell organelle referred to as the endoplasmic reticulum. A failure in the quality control system causes endoplasmic reticulum stress and eventually cell death.

"It is very interesting that although the SEL1L gene is expressed in several different tissues, we only saw pathological changes in the cerebellar cortex of affected dogs. It is known that certain neurons in the cerebellar cortex seem to be very sensitive to endoplasmic reticulum stress, which might offer some explanation to the cerebellum-restricted cell loss", tells M.Sc Kaisa Ky?stil?, the first author of the article. "We were also able to measure increased endoplasmic reticulum stress in the affected puppies' cerebellar cortex, which gives more support to SEL1L as the causative gene in Finnish Hound ataxia", Ky?stil? adds.

Finnish Hound ataxia is a single gene defect, inherited in an autosomal recessive manner. According to the research, 10% of Finnish Hounds carries the recessive ataxia mutation in their genome. A genetic test has been developed for breeding purposes. The test has enabled to identify disease carriers, and when mated with non-carriers, they too can be used in breeding programs. If all carrier dogs were excluded by breeders, the genetic diversity of the breed could be affected. The Finnish Hound ataxia test is offered by a DNA-test laboratory Genoscoper (genoscoper.com), and is the first test for a native Finnish breed developed by the research group.

France reaches Euro 2012 quarters despite 2-0 loss

KIEV, Ukraine (AP) ? France was outplayed, outfought and outscored, and that was against a team with nothing to play for.

With world champion Spain now waiting in the quarterfinals of the European Championship, things better improve quickly for the French to stand a chance of going any further.

France limped into the knockout round of Euro 2012 despite a 2-0 loss to Sweden in their final group game, showing just how much the team still needs to improve to be true contenders in the tournament. The French finished second in Group D after England beat Ukraine 1-0, and will face Spain on Saturday in the quarterfinals.

"You have to be optimistic to think that we can beat Spain, but it's hard right now to imagine that we can. We have to do better on Saturday," France coach Laurent Blanc said. "We wanted to finish top of the group but couldn't manage it, so we have to deal with that."

France's 23-game unbeaten streak came to a crashing end as the already-eliminated Swedes exposed frailties in the back four and neutralized the dual attacking threat of Karim Benzema and Franck Ribery.

The Swedes dominated proceedings for much of the game and Zlatan Ibrahimovic broke the deadlock with a piece of artistry in the 54th minute, sending a spectacular volley past helpless goalkeeper Hugo Lloris. Sweden had plenty of chances to add a second before Sebastian Larsson finally did in injury time to secure the team's first points of the tournament.

"We really wanted to win this game for the fans, their support has been fantastic," Ibrahimovic said. "We wanted to finish this strongly for them."

Perhaps France can still do the same, but the team has big problems to solve in both defense and attack.

"We were too average in too many areas to hope to win this match," Blanc said. "The Swedish team played with all their hearts, they were better prepared than us. They had a player in their ranks (Ibrahimovic) who made the difference. If you analyze the game, we were in trouble for most of it.

"We're very disappointed with how we played. The main thing is that we've qualified."

England finished with seven points, while France had four and Ukraine and Sweden bowed out with three each.

France looked lackluster throughout much of the game and lacked clinical finishing when it did threaten the Swedish goal.

Substitute Jeremy Menez had France's best chance to equalize when he broke into the area in the 81st minute but his low shot was stopped by goalkeeper Andreas Isaksson's leg. From the resulting corner, Olivier Giroud headed just wide.

Benzema was largely ineffective again and remained scoreless at the tournament. Ribery had France's best chance in the first half when the ball fell to him on the left edge of the area but his shot was parried by Isaksson.

Instead, it was Ibrahimovic who stole the show with another spectacular goal to add to his resume. The tall AC Milan striker met Larsson's cross from the left and put himself nearly sideways in the air before striking the ball perfectly past Lloris.

"It was a perfect cross from Seb," Ibrahimovic said. "The whole team played a fantastic game today."

Lloris then single-handedly kept France in the game over the next few minutes as Sweden kept pressing, making point-blank saves to deny Christian Wilhelmsson and Olof Mellberg.

Larsson finally added the second by emphatically volleying a rebound into an empty net, giving the large contingent of Swedish fans a reason to celebrate.

"It's mixed emotions right now," Sweden coach Erik Hamren said. "We should be happy with the victory and the performance. ... But at the same time, there's a sense of sadness in us all because we would have wanted to stick around a bit longer."

SPIN METER: Candidates trade misquoting charges

WASHINGTON (AP) ? President Barack Obama and Republican rival Mitt Romney can speak with authority when they complain that their words have been taken out of context. They've not only been victims of the tactic, they've also used it to great effect themselves.

In an unforgiving election season, every sentence spoken by the candidates is sliced and diced by the opposition for political gain, and unflattering statistics are cherry-picked to pack the most devastating punch. The campaigns pounce on any ill-advised remark and cry foul when their own slip-ups get similar treatment.

The tussle over recent comments by Obama and Romney on the economy is a skirmish in which both sides have lobbed out-of-context complaints after snippets of their words were isolated and held up to ridicule.

Obama, at a news conference June 8, spoke six words that quickly came back to bite him: "The private sector is doing fine."

Romney's response boomeranged, too. Noting that the president had said the country needs more firefighters, police officers and teachers, Romney said the public thinks "it's time for us to cut back on government and help the American people."

Does Romney really want to slash firefighters, police and teachers?

Both campaigns went into overdrive, trying to turn their opponent's quotes into votes by quickly churning out mocking web videos and a barrage of caustic emails.

Romney said of Obama: "Is he really that out of touch?"

The Obama campaign repackaged Romney's remarks about public workers as "Mitt Romney's Job Elimination Plan."

No matter that both candidates quickly came back before the cameras to try to explain what they really meant.

Obama said he'd meant to highlight job growth in the private sector that was providing good economic momentum. Romney said it would be "completely absurd" to think he wants to cut police, firefighters and teachers.

Obama suggested there will be plenty more back-and-forthing in the context game.

"There will be no shortage of gaffes and controversies that keep both campaigns busy and give the press something to write about," he said. "You may have heard I recently made my own unique contribution to that process. It wasn't the first time. It won't be the last."

Already, 2012 is shaping up as a huge year on this count.

Taking quotes out of context "has been the dominant tactic of deception in the campaign," says Kathleen Hall Jamieson, author of "Dirty Politics: Deception, Distraction, and Democracy" and director of the Annenberg Public Policy Center at the University of Pennsylvania. "It has been used in the past, but not this extensively."

The center's flackcheck.org website calls out candidates and campaign groups for taking words and statistics out of context.

Jamieson says the thrashing that Obama took over his "private sector" remark amounts to a case of what goes around, comes around.

In 2008, Obama's campaign was merciless when Republican rival John McCain said during the midst of economic turmoil that "the fundamentals of the economy are strong."

McCain was right, and was trying to serve as a voice of reassurance to a nervous public about what might happen next. But Obama's campaign successfully turned the words into ads that painted the Republican as out of touch with the economic concerns of ordinary people.

"That repeatedly aired ad increased the likelihood that people thought that McCain wasn't competent to handle the economy, and that is dramatically out of context," Jamieson said. "McCain's statement was inarticulate, but appropriate."

Obama's camp has been equally aggressive at getting maximum mileage out some of Romney's cringe-worthy comments.

There was this: "I'm not concerned about the very poor."

And this: "Corporations are people."

And this: "I like being able to fire people."

Romney has explanations for them all. The firing remark, for example, had nothing to do with his corporate past. It was his way of saying consumers should be able to switch their health insurance if they're not getting good service from their current provider.

But many people will remember only the offending sound bites, recirculated by the candidate's critics.

Romney's campaign, in turn, pulled off its own blatant case of out-of-context advertising when it released a spot last November that had Obama saying: "If we keep talking about the economy, we're going to lose."

In fact, Obama was quoting McCain.

The full 2008 quote from Obama: "Sen. McCain's campaign actually said, and I quote, 'If we keep talking about the economy, we're going to lose.'"

Jamieson said the damage from out-of-context quotes goes beyond the misleading impressions that are cast, making candidates wary of speaking freely.

It also can be a distraction from the real issues that divide the candidates.

Obama and Romney do have fundamental differences over how to handle the U.S. economy, but that can get lost in the finger-pointing over who is misusing the other's quotes.
